Titled vs concession: what to check on any beachfront property
Costa Rica’s Maritime Zone Law governs all land within 200 meters of the high tide line. The first 50 meters is public and cannot be privately owned by anyone. The next 150 meters is the restricted zone, where a property may be held under a concession, which is a government-granted license to use the land and not ownership. Beyond that, and on beachfront land that carries its own registered title, property is fee-simple with full private ownership.
Always verify the title type with an independent attorney before making an offer on any beachfront property. Our guide explains both in detail: Fee-Simple vs. Concession Property: What Every Foreign Buyer Must Know.
Beachfront buying FAQ
On fee-simple (titled) land, foreigners have the same property rights as Costa Ricans and can own outright. On concession land inside the Maritime Zone, a foreign national cannot hold more than 49% of the entity that holds the concession without five or more years of legal Costa Rican residency.
Titled, or fee-simple, property is full private ownership registered with Costa Rica’s National Registry. A concession is a government-granted license to use land in the restricted zone, 50 to 200 meters from the high tide line. The land stays state property, and concessions are typically granted for 20-year periods and are renewable.
The first 50 meters from the high tide line is the Public Zone. It is state-owned and no private occupation, construction or title is permitted there.
Budget 3.5 to 5% of the purchase price on top of the price itself: transfer tax of 1.5%, registry and documentary fees of about 0.80%, attorney fees of 1.25 to 1.5%, and an escrow fee. See our closing costs guide.
Annual property tax in Costa Rica is 0.25% of the declared value.
